These Terms apply to your use of Lucky Seven’s booking services (app, website, telephone) and related customer support and payment collection services.

1. Contractual relationship with Lucky Seven
1.1 These Terms govern your access to and use of Lucky Seven’s applications, websites, content and booking-related services (the Lucky Seven Services).
1.2 By making a booking through any available method, you confirm your agreement to be bound by these Terms.
1.3 These Terms supersede all prior agreements or understandings (oral or written) relating to the Lucky Seven Services.

2. What we do (and what we don’t do)
2.1 Lucky Seven / we / us means Lucky Seven Private Hire Ltd trading as Lucky Seven Private Hire / Lucky Seven Taxis.
2.2 Lucky Seven operates as a technology and dispatch/booking platform and provides: booking facilitation, dispatch, customer support, and (where available) payment collection.
2.3 Lucky Seven does not provide transportation and is not the carrier.
2.4 Transportation services are provided by independent, self-employed private hire drivers (each a Driver or Carrier) who are not employees of Lucky Seven.

2.5 Lucky Seven acts as the Driver’s disclosed agent when arranging bookings and (where applicable) collecting payment for fares and charges.

3. Agency and who your transport contract is with
3.1 Lucky Seven acts as the Driver’s disclosed agent when arranging and confirming bookings and, where applicable, collecting payment.
3.2 When a Driver accepts your booking request, a separate contract for the journey (the Transport Contract / contract of carriage) is formed between you and the Driver.
3.3 Lucky Seven is not a party to the Transport Contract.
3.4 Lucky Seven may issue booking confirmations, journey updates, receipts and other communications on the Driver’s behalf.

4. Statutory and licensing override
4.1 Nothing in these Terms is intended to exclude or limit any responsibility or liability that cannot be excluded by law, including obligations or liabilities that may arise under applicable private hire legislation and local licensing requirements (including, where applicable, section 56 of the Local Government (Miscellaneous Provisions) Act 1976).
4.2 If any part of these Terms conflicts with mandatory legal requirements, those mandatory requirements prevail.

5. Definitions
In these Terms:

Booking: a request for a journey made through the Lucky Seven Services.

Driver / Carrier: the independent private hire driver who accepts and performs your Booking.

Fare: the amount payable for the journey under the Transport Contract.

Charges: the Fare plus any additional charges (including waiting time, cancellation/no-show, soiling, tolls/parking/road charges, destination changes, damage/extra cleaning).

You / Customer: the person making the Booking (and, where relevant, the lead passenger).

6. Eligibility, legal capacity and your responsibilities
6.1 You must be at least 16 years old to register for an account or make a Booking.
6.2 By using the Lucky Seven Services you confirm you have the legal capacity to enter into contracts and accept financial responsibility for Charges relating to your Booking.
6.3 You must provide accurate contact details and correct pickup and destination information and keep them updated.
6.4 You are responsible for activity under your account/phone number and for keeping login details secure.

7. Booking process
7.1 You may place a Booking via app, website, telephone, or other channel made available by Lucky Seven.
7.2 You must provide correct details including pickup point, destination, number of passengers, luggage, and any special requirements.
7.3 We will send a confirmation (e.g., SMS/email/app notification) confirming your request has been received and/or that a Driver has been allocated/accepted.
7.4 Driver acceptance: the Transport Contract is formed when a Driver accepts the Booking. Lucky Seven will notify you of acceptance on the Driver’s behalf.
7.5 If no Driver accepts, or a Driver cancels before pickup, Lucky Seven may attempt to allocate another Driver. If we cannot, the Booking may be cancelled (subject to your statutory rights).

8. Changes to your Booking
8.1 If you change the destination, add stops, change pickup details, or otherwise vary the Booking after it is accepted, this may:

change the Fare/Charges; and/or

require renewed acceptance by a Driver.
8.2 Additional Charges may apply for address/destination changes after confirmation, extended waiting, or additional stops.

9. Fares and Charges (payable to the Driver)
9.1 Fares and Charges are set by and owed to the Driver under the Transport Contract, subject to any price information shown to you at booking.
9.2 A minimum charge may apply.
9.3 Charges may include (non-exhaustive):

Waiting time: £0.30 per minute after 4 minutes.

Soiling fee: £30–£60 depending on severity (including domestic animal soiling).

tolls, parking, and road-related charges (where applicable);

address/destination changes after confirmation, additional stops, extended waiting;

damage or extraordinary cleaning/repair costs caused by passengers.
9.4 Where Charges are estimated or quoted based on information provided, the final Charges may differ due to route changes, traffic, stops, waiting time, or corrections to booking details.

10. Payment (collection as agent) and payment protection
10.1 Who you pay: All Fares and Charges are owed to the Driver.
10.2 Payment collection: where card/in-app payment is used, you authorise Lucky Seven to collect Fares and Charges as the Driver’s agent and remit them to the Driver.
10.3 Pre-authorisation: for card payments, a pre-authorisation/hold may be placed at the time of booking. This may be for the full estimated amount or another amount required to verify your payment method and available funds.
10.4 Declined payments: if a payment method is declined, you authorise Lucky Seven (as agent) to attempt collection using any other registered payment method and/or restrict access to the Lucky Seven Services until payment is completed.
10.5 Payment methods: you may be able to pay by cash, card, or other digital methods depending on availability.
10.6 Receipts: receipts may be issued by Lucky Seven on behalf of the Driver.

11. Loyalty points (if offered)
11.1 Lucky Seven may offer a loyalty points scheme via the app.
11.2 We may amend, suspend, withdraw, modify or revoke loyalty points at our discretion (including eligibility, accrual, expiry and redemption), including without notice where reasonably necessary.

12. Refunds and adjustments
12.1 If you believe you have been charged incorrectly, contact support at info@luckyseventaxis.co.uk promptly with Booking details.
12.2 Where an adjustment is approved, refunds are typically processed back to the original payment method. Processing times depend on banks/payment providers. Where applicable, refunds may be initiated within 8 days.

13. Cancellations and no-shows
13.1 Before a Driver is allocated/accepted: you may cancel without charge.
13.2 After a Driver is allocated/accepted: cancellation fees may apply, payable to the Driver and collected by Lucky Seven as agent:

cancellation more than 24 hours before pickup: no charge;

cancellation less than 24 hours before pickup: may be charged up to 100% of the quoted Fare/Charges;

no-show: 100% of the quoted Fare/Charges may be charged if you do not attend the pickup point or cannot be contacted.
13.3 What counts as a no-show includes (non-exhaustive): failure to arrive within a reasonable time, failure to respond to calls/messages, or providing an incorrect pickup location.
13.4 Once a Driver is allocated/accepted, any applicable fees may be deducted automatically from the payment method used (or another registered method).

14. Passenger conduct and termination of journeys
14.1 You and your passengers must not smoke/vape in the vehicle, harass the Driver, behave disruptively, or act in a way that is unsafe, abusive or discriminatory.
14.2 Drivers may refuse service, end a journey, or request you leave the vehicle if conduct is inappropriate or safety is at risk. Where this occurs, the full Fare/Charges may remain payable.
14.3 Lucky Seven may suspend or terminate your access to the Lucky Seven Services for breach of these Terms, misuse of the platform, or non-payment.

15. Luggage, property, and lost items
15.1 You are responsible for your luggage and personal belongings.
15.2 Lucky Seven may assist with lost-property enquiries, but recovery depends on the Driver and circumstances and cannot be guaranteed.

16. Children and vulnerable passengers
16.1 You must comply with applicable child seat/booster seat laws. If you require a child seat, you must specify this at booking and (unless explicitly offered) provide one.
16.2 If you book for another passenger, you are responsible for ensuring you have their consent to share their details and that they comply with these Terms.

17. Animals
17.1 Assistance animals are carried as required by law.
17.2 Other animals are carried at the Driver’s discretion and may be subject to additional Charges, including soiling fees where applicable.

18. Driver insurance and responsibility
18.1 Drivers are independent contractors and are responsible for maintaining all required licences and hire-and-reward, vehicle and public liability insurances applicable to the transportation services they provide.
18.2 Lucky Seven does not provide transportation insurance for Drivers and is not responsible for a Driver’s failure to maintain required insurance, subject always to Section 4 (Statutory and licensing override) and your statutory rights.

19. Complaints and support
19.1 For issues relating to the Lucky Seven Services (app, booking, dispatch, payment processing), contact info@luckyseventaxis.co.uk.
19.2 For issues relating to the Transport Contract (driving, vehicle condition, route, conduct), Lucky Seven may pass your complaint to the Driver and assist with communications, but the Driver is the provider of the transportation service.
19.3 In an emergency, contact emergency services first.

20. Data protection (UK GDPR)
20.1 Lucky Seven complies with UK data protection law (including the UK GDPR and Data Protection Act 2018).
20.2 Personal data is used for processing bookings, operating the platform and providing customer support.
20.3 You may request access, rectification or deletion of your personal data by contacting info@luckyseventaxis.co.uk.

21. Acceptable use and intellectual property
21.1 The app, website, logos and content are owned/licensed by Lucky Seven.
21.2 You may use the Lucky Seven Services for lawful personal use only.
21.3 You must not copy, scrape, reverse engineer, disrupt or misuse the platform, or interfere with its operation.

22. Cybersecurity and platform risk
22.1 While we take reasonable steps to operate the platform securely, you acknowledge that use of apps/websites involves inherent risks.
22.2 To the maximum extent permitted by law, Lucky Seven is not liable for damage to your device, computer equipment, or data (including viruses or other harmful material) arising from your use of the Lucky Seven Services, except where caused by our negligence and not excluded by law.

23. Force majeure
Neither Lucky Seven nor the Driver is liable for failure to perform obligations caused by events beyond reasonable control (including severe weather, major network outages, or emergencies), subject to non-excludable legal rights.

24. Liability
24.1 Driver liability: the Driver is responsible for providing the transportation services and performance of the Transport Contract.
24.2 Lucky Seven liability: Lucky Seven is responsible for providing the Lucky Seven Services with reasonable care and skill.
24.3 To the maximum extent permitted by law, Lucky Seven is not liable for:

the Driver’s acts or omissions during the journey;

indirect, incidental, or consequential losses (including loss of profit/revenue/business opportunity);

missed connections (flights/trains/appointments) as journey times are estimates subject to traffic, roadworks and peak periods;

loss or damage to personal belongings (you remain responsible for your property);

delays due to traffic, weather, road closures or events beyond our reasonable control.
24.4 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.
24.5 This section does not affect your statutory rights.

25. Changes to these Terms
25.1 We may update these Terms from time to time. The latest version will be made available on the app/website.
25.2 Changes apply from the effective date shown, and to Bookings made after that date (and, where necessary, to ongoing platform use).

26. Entire agreement
26.1 These Terms form the entire agreement between you and Lucky Seven regarding the Lucky Seven Services and supersede prior agreements/understandings relating to those services.
26.2 The Transport Contract is a separate agreement between you and the Driver once the Driver accepts your Booking.

27. Governing law and jurisdiction
27.1 These Terms are governed by the laws of England and Wales.
27.2 Subject to any mandatory consumer rights, disputes relating to these Terms or the Lucky Seven Services shall be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
